Terms of Service
Effective: 28 May 2026 · Version 1.3 (updated 6 October 2026)
These Terms of Service (“Terms”) govern your use of 9ty Football's mobile and web applications (“9ty”, “the Service”). By creating an account, you accept these Terms. If you do not agree, please do not use the Service.
1. Who we are
9ty Football is operated by Daniel Sheccoury (see Impressum). References to “we”, “us”, and “our” below refer to that operator.
2. What 9ty is
9ty is a digital service for amateur football squads to: organise weekly matches, sign players up to games, draft balanced teams, track match statistics (goals, assists, fouls, cards, minutes, performance), chat with squad members, and optionally connect a Strava account or use voice + AI features to log match events.
9ty is not a betting, fantasy sports, or gambling platform. We do not pay out cash prizes, accept wagers, or process any money flow between squad members. Per-game player fees tracked in the app are informational only; settlement is between you and your squad organiser.
3. Account and eligibility
- You must be at least 16 years old to create an account.
- You must provide a real email address that you control. Each person may hold one personal account.
- You are responsible for keeping your sign-in code or magic-link email secure. We will never ask you for your sign-in code by phone or in chat.
- You can delete your account at any time from the Me tab in the mobile app. Deletion is described in §10.
4. Acceptable use
You agree not to:
- Post harassing, defamatory, threatening, hateful, sexually explicit, or otherwise unlawful content in any squad chat.
- Upload photos that depict identifiable minors without their parent or guardian's consent.
- Impersonate another person or misrepresent your affiliation with a squad or organisation.
- Use the Service to send unsolicited marketing or spam.
- Attempt to reverse-engineer, scrape, or otherwise access the Service's backend in ways not provided by the official mobile or web apps.
- Copy, modify, sublicense, sell, lease, or otherwise commercially exploit the Service or any part of it.
- Create derivative works, competing products, or clones based on the Service.
- Redistribute the app's installer, APK, or IPA files to third parties.
- Remove any copyright, trademark, or proprietary notices from the app or its assets.
- Use the AI features (voice events, match recap) to generate or attempt to generate content that violates Anthropic's Acceptable Use Policy.
We may suspend or terminate accounts that violate these rules. See §10.
Zero tolerance. 9ty does not tolerate objectionable content or abusive users. Chat messages and photos are checked automatically before they are shown, and content that breaks these rules is not posted. Any player can report content or block another player. Squad admins and 9ty review reports within 24 hours and remove the content and, where needed, the person responsible.
5. User-generated content
You retain ownership of everything you post (chat messages, photos, match data). You grant 9ty a limited, royalty-free licence to host, display, and process that content solely for the purpose of operating the Service for you and your squad.
Squad chat content is visible only to members of that squad. It is not indexed publicly. Photos you attach to chat are served from Supabase Storage with access scoped to squad members only.
6. AI features (voice events and match recap)
9ty includes two optional features powered by Anthropic's Claude Haiku large language model:
- Voice event capture — your phone records a short audio clip, which our server sends to OpenAI's Whisper for transcription; the transcript is then sent to Claude to extract a structured match event. The audio is not stored.
- Match recap — after stats are entered, Claude generates a short prose recap from the event log + stats.
AI output is not guaranteed accurate. Claude may misinterpret a transcript, mis-attribute a goal, or write a recap that contains errors. We treat AI output as a draft that the squad's admin can edit or delete. You should not rely on AI output for anything legally consequential.
See the Privacy Policy §2.4 and §2.5 for the data flow.
7. Subscriptions and payments
The core of 9ty is free to use. Some features require a Pro subscription (Admin Pro or Player Pro). You can buy it by card on our website or in the app, billed by us through Stripe, or as an in-app purchase through the Apple App Store or Google Play (see §7.5).
7.1 Billing
- Subscriptions auto-renew at the end of each billing period unless cancelled.
- You can cancel anytime from the Manage Subscription link in the app. Cancellation takes effect at the end of the current billing period; you retain access until then.
- Prices are shown including applicable VAT.
7.2 Right of withdrawal (§11 FAGG)
As a consumer with a residence in the European Union, you have a 14-day right of withdrawal from the date you place a subscription order, under §11 Fern- und Auswärtsgeschäfte-Gesetz (FAGG). To exercise it, send an email to 9tyfootball@gmail.com with the subject “Widerruf” before the 14 days expire.
Free trial and withdrawal: a new subscription starts with a free trial when one is available. The trial is longer than the 14-day withdrawal period, so you are not charged while you can still withdraw. If your subscription starts without a free trial and you withdraw within the 14 days, we refund the full amount. We do not ask you to give up your right of withdrawal. Details and the model withdrawal form: Right of withdrawal.
7.3 Refunds
Outside the §11 FAGG withdrawal window, refunds are at our discretion. We will generally refund unused billing periods if the Service was materially broken for you and we could not fix it within a reasonable time.
Yearly subscriptions are non-refundable beyond the statutory 14-day FAGG window. When you purchase a yearly subscription by card, the checkout flow asks you to confirm this understanding before the Pay button activates. You are also asked to acknowledge that your subscription is tied to your account rather than to any specific squad (see §7.4).
7.4 Subscriptions are tied to your account, not to a squad
Your Pro subscription provides features (extended stats, larger squads, advanced AI features) that are available to you as a user, regardless of which squad you are in at any given moment.
If a squad admin removes you from their squad (see §10.1), your subscription is not terminated, paused, or refunded — it continues to work in any squad you are still a member of, or in any squad you join afterwards. Squad membership is governed by the squad's admin and is not a service we guarantee to you in exchange for your subscription fee.
7.5 Purchases through the App Store or Google Play
- If you subscribe through the Apple App Store or Google Play, Apple or Google sells you that subscription. Payment, renewal, cancellation and refunds are handled by them under their terms. You manage the subscription in your Apple ID or Google Play account; the Manage button in the app opens it.
- The price, any free trial and taxes are the ones the store shows you. The store decides whether you are eligible for a free trial.
- Requests for withdrawal or refunds of store purchases go to Apple (reportaproblem.apple.com) or Google (Play Store → Payments & subscriptions → Budget & order history). We cannot issue refunds for purchases made through a store. Sections 7.2 and 7.3 apply to subscriptions bought by card from us.
- Your subscription is linked to your 9ty account. If you reinstall the app or change phones, use Restore purchases.
- Only keep one subscription per plan (Admin or Player). If you already have Pro by card, you do not need to buy it again in a store, and the other way round. Cancel the one you do not need, since we cannot refund a duplicate bought through a store.
8. Service availability
9ty is offered “as is”. We aim for high availability but do not guarantee uptime, error-free operation, or that any specific feature will be preserved indefinitely. We may add, change, or remove features over time; material changes affecting paid features will be announced in the app at least 14 days in advance.
9. Limitation of liability
To the extent permitted by Austrian law, we limit our liability as follows:
- We are liable without limit for damages caused intentionally or by gross negligence, for injury to life, body, or health, under the Austrian Produkthaftungsgesetz (PHG), or in the event of a guarantee we have given.
- For damages caused by simple negligence in breach of a material contractual obligation, our liability is limited to the foreseeable damage typical for this kind of contract.
- We exclude liability for simple negligence in non-material obligations.
10. Termination
10.1 Removal from a squad by its admin
Squad admins may remove any non-admin member of their squad at any time and for any reason consistent with the squad's house rules. We do not adjudicate between admins and their members; that decision is the admin's.
When you are removed from a squad:
- You lose access to that squad's chat, games, and roster immediately. Your historic match data (events you participated in, photos you posted, statistics you accumulated) remains attached to past games for the squad's record.
- Your 9ty account is unaffected. You can keep using the Service in other squads you belong to, and you can join new squads.
- Your Pro subscription, if any, is unaffected — see §7.4.
- You cannot be re-invited to the same squad for 30 days from the removal. This cooldown is enforced automatically.
- The reason the admin entered for the removal is logged for their records and visible to co-admins of that squad. It is not shown to you.
10.2 Termination of your 9ty account
You can delete your account anytime from the Me tab in the mobile app. Deletion removes your profile and anonymises your residual references (chat messages, match events) in shared records within 30 days.
We may suspend or terminate your account if you materially violate these Terms (e.g. repeated harassment of squad members, abuse of AI features, or fraudulent payment activity). Where reasonable, we will notify you and give you a chance to remedy the violation before terminating.
11. Intellectual property
The 9ty Football mobile app, admin web, backend code, illustrations, database schema, and documentation are our intellectual property (or licensed to us). Creating an account grants you a personal, non-exclusive, non-transferable licence to use the Service for organising and playing amateur football — nothing more.
The names “9ty Football” and “9ty”, the amber-and-crimson club crest, and the visual identity of the app are our trademarks. Personal use inside the Service is fine. Unauthorised commercial use — putting our mark on a competing service, using the crest in your own product, or selling merchandise with our identity — requires written consent.
The content you upload (chat messages, photos, match data, comments) stays yours. §5 covers the licence you grant us to display it inside the Service.
If you build a genuinely useful integration or want to embed 9ty features in your own tool, get in touch — we may licence some pieces on request.
12. Changes to these Terms
We may update these Terms. Material changes will be flagged in the app on next launch and you will be asked to accept them before continuing to use paid features. Non-material changes (typos, clarifications) may be made without notice; the version and effective date above will be updated.
13. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Austria, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-laws rules of Austrian private international law. If you are a consumer, this choice of law does not deprive you of the mandatory consumer protection rules of the country where you habitually reside (Art. 6 Rome I Regulation).
Exclusive place of jurisdiction for disputes with merchants (Unternehmer) is Vienna, Austria. Consumer claims may also be brought in the consumer's place of residence (§14 KSchG / Art. 18 Brussels I-bis Regulation).
14. EU Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR) at ec.europa.eu/consumers/odr. We are not obliged to and do not participate in dispute resolution proceedings before a consumer arbitration board.
